Consent is modular, apparently. A woman consents to sex, then withdraw a portion of that consent, after he grabbed her breasts repeatedly.

He’s since been convicted in court for sexual assault, despite the fact that she had no problem with anything else they did together in the bedroom.

Despite it being consensual sexual intercourse, 37-year-old Philip Queree was found guilty of the crime. The plaintiff claims that he grabbed her breasts “really hard” to the point that she started crying, and was left bruised following the encounter.

The two decided to have sex following their second date on Tinder, and had been texting each other for two weeks leading up to the encounter.

She accused Queree, who is a medical graduate at King’s College London, of using “excessive force” after she told him not to touch her breasts even as they were engaged in sex.

Queree was convicted during a trial in August at the Jersey Magistrates Court of a single count of indecent assault. He pled not guilty to the charge. Magistrate Bridget Shaw declared: “I am sure that Miss X withdrew consent for Queree to grab her breasts. Queree knew this but continued to do so forcefully, causing the complainant considerable pain.”

According to the plaintiff, she continued to consent to him having sex with her, but withdrew her consent to touch her breasts.

“This was an assault. Queree touched a sexual and intimate part of her body in a sexual manner without her consent,” continued the judge. “Irrespective of her consent to other sexual conduct, I am sure that the touching was in circumstances of indecency and thus Queree is guilty of indecent assault.”

Shaw described it as a “serious sexual assault,” adding that “It is not the most serious sexual assault, but it is not at the lower end of the scale.”

The plaintiff claims that following the encounter, she had difficulty lifting her arm and complained of a painful shoulder. She decided to file a report with the police after talking to friends and family about it.

Following the trial, Queree has been put on the Sex Offenders’ Register for five years, which has effectively ended his pursuit of becoming a doctor. He is also ordered to perform 180 hours’ community service and pay £2,000 ($2645) towards prosecution costs.

Queree’s lawyer, David Stinson, says that he is now forced to claim income support and live on £92 ($121) a week while living at his parents’ home because he is unable to get a job.

“He has no savings. He has, essentially, been an academic most of his life. Going forward, he has little chance of getting work in the medical field as a result of this conviction,” said Stinson.

            There are two scenarios that I was thinking of; the first is that he hurt her by squeezing her breasts too hard, she told him no, and he grabbed her again, that one I think is chargeable. … However as you pointed out, to be creditable she’d have had to kick him out of her bed at that point, not continue to have sex.

            The second scenario is that he grabbed her, she said no and he respected her wish, in which case he didn’t do anything wrong other than get a little rough and should not have been charged.

    Sounds like the judge “Magistrate Bridget Shaw” was highly biased. This case actually seems ridiculous. She consented to sex but because he touched her breasts that part is indecent and not the sex as a whole so the woman’s behavior is considered OK but the man’s behavior is considered indecent because it was during sex. Maybe the guy should sue her for inflicting harm on his penis. He should have said he squeezed her breasts as a means to prevent falling into her cavernous vagina.

    It is pretty hard to agree with consensual sex if someone is repeatedly hurting you. It’s a big turn off. Particularly for women. I find it difficult to believe that she continued to say please continue but leave my breasts alone after he hurt her leaving her bruised.
